TikTok faces a critical challenge as it strives to prevent its imminent ban in the United States. However, a glimmer of hope has emerged with the US Supreme Court agreeing to consider TikTok’s arguments against the expected prohibition. Here are the key points.
US Supreme Court to Review TikTok’s Challenge on January 10
Following a law enacted by the US Congress and endorsed by President Biden, TikTok is poised for a ban in the US unless ByteDance divests its US interest in the platform.
So far, attempts by ByteDance to challenge these actions have been unsuccessful.
Nonetheless, there remains one last legal route to prevent the looming ban: the US Supreme Court.
Today, the Supreme Court officially announced it will hear the case on Friday, January 10, 2025.
The court will allocate two hours for oral arguments presented by TikTok and its legal adversaries.
Both parties must adhere to several deadlines prior to the hearing.
According to the Supreme Court’s directive:
The parties are instructed to electronically file simultaneous opening briefs, limited to 13,000 words, along with a joint appendix by 5 p.m. (EST), Friday, December 27, 2024. Reply briefs, capped at 6,000 words, should be filed electronically by 5 p.m. (EST), Friday, January 3, 2025. Any amicus curiae briefs must also be filed electronically by 5 p.m. (EST), Friday, December 27, 2024.
The hearing date of January 10 doesn’t leave much time before the January 19 deadline.
There’s a chance the Supreme Court may expedite its ruling following the January 10 session; however, it would be atypical for a decision to be rendered almost immediately.
Additionally, President-elect Donald Trump has expressed intentions to possibly reverse the ban if feasible, with his inauguration set for the day after the January 19 deadline.
Regardless, the Supreme Court’s involvement is promising news for TikTok and its parent company ByteDance, as it indicates a renewed opportunity for their legal argument.
